Continued browsing on this site implies unreserved acceptance of the following terms and conditions of use.

Terms of Service

 

These General Conditions of Use (CGU) are intended to define the conditions under which the User can benefit from the Services provided by the Site.

Article 1 – Access to the Site

 

Use of the Site implies full acceptance of the General Conditions of Use described below. These conditions of use may be modified or supplemented at any time, Users of the Site are therefore invited to consult them on a regular basis. This Site is normally accessible to Users at any time. An interruption due to technical maintenance may however be decided on a temporary basis. The Site is updated regularly. In the same way, the legal notices can be modified at any time: they nevertheless impose themselves on the User who is invited to refer to them as often as possible in order to become acquainted with them. Access to the Site and its use are reserved for adults and for strictly personal use. You agree not to use this Site and the information or data contained therein for commercial, political, advertising purposes and for any form of commercial solicitation and in particular the sending of unsolicited e-mails.

Article 2 – Scope

 

These General Conditions of Use are in force as of January 30, 2023. They are applicable to any use of the Site by the User. These conditions are subject to French law: any foreign User expressly accepts the application of French law by using the Services. In the event that a particular contractual clause is null, illegal, or inapplicable, the validity of the other provisions of the General Conditions will not be affected in any way.

Article 3 – Features

The User accesses the Services via the Site www.glshift.com which presents the support services offered. On the Site, the User can: access free digital content, learn about topics related to the services offered via the blog posts, send a contact request via a form, contact us to make an appointment or ask us any questions.

Article 4 – Conditions of access to services

The Services are open to everyone but their use is subject to the following conditions:

  • To be of age ;

  • Acknowledge having read and understood the entirety of these General Conditions of Use, and accept them without restriction or reservation;

  • Consent to the collection and processing of information or authentic personal data necessary for the proper functioning of the Services, and this in strict compliance with our consultation on www.glshift.com and the personal data protection rules in force.

 

Article 5 – Rules of good conduct on the Site

Access to the Services implies that the User undertakes to accept and strictly respect the rules below:

  • The User undertakes to use the Services only for personal purposes: the Services may in no way be used for commercial or profit-making purposes, and in particular may not under any circumstances be used to collect commercial information. ;

  • The User undertakes not to access and use the Site or the Services provided by the owner of the Site for illicit purposes or with the aim of causing him, as well as the professionals who represent him, harm or more generally to infringe their rights, in particular intellectual property;

  • The User agrees not to use devices or software other than those provided on the Site for the purpose of affecting or attempting to affect the proper functioning of the Site or the Services or to extract or modify all or part of the Site;

  • The User undertakes not to copy all or part of the content present on the Site on any medium whatsoever without written authorization from the owner of the Site;

  • In general, the User undertakes to access and use the Site and the Services in good faith, in a reasonable manner, not contrary to the terms of this Charter and for strictly personal use and for non-profit purposes. In the event of breach of one or other of these commitments, and without this list being exhaustive, the User acknowledges and accepts that the owner of the Site will have the option of refusing him, unilaterally and without prior notification, the access to all or part of the Website. 

 

Article 6 – Content of the Site and intellectual property

All trademarks, photographs, texts, comments, illustrations, animated or still images, video sequences, sounds, as well as all computer applications that could be used to operate the Site and more generally all elements reproduced or used on the Site are protected by the laws in force under intellectual property, including in particular article L.122-4 of the Intellectual Property Code. They are the full and entire property of the Publisher or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the Publisher, is strictly prohibited. Any unauthorized use of the Site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

Article 7 – Site Management

For the proper management of the Site, the Publisher may, at any time:

  • Suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or to certain parts of the Site, to a specific category of Internet users;

  • Delete any information that could disrupt its operation or contravene national or international laws;

  • Suspend the Site in order to make updates.

 

Article 8 – Liability

The Site is in principle accessible to Users 24 hours a day, 7 days a week, except for interruption, scheduled or not, for the purposes of its maintenance or in the event of force majeure. If it is impossible to access the service, G&L Shift OÜ undertakes to take all necessary measures to restore access to the Site. However, the responsibility of the Editor cannot be engaged in the event of failure, breakdown, difficulty or interruption of operation, preventing access to the Site or to one of its functionalities.

The Site connection equipment used by the User is under his full responsibility. He must take all appropriate measures to protect his equipment and his own data, in particular from viral attacks via the Internet.

 

The User is also solely responsible for the sites and data he consults. G&L Shift OÜ cannot be held responsible in the event of legal proceedings against it:

  • due to the use of the Site or any service accessible via the Internet;

  • due to the User's non-compliance with these general conditions.

 

G&L Shift OÜ is not liable for any damage caused to the User, third parties and/or their equipment as a result of their connection or use of the Site and they waive any action against the company as a result. If G&L Shift OÜ were to be the subject of an amicable or legal procedure because of their use of the Site, it may turn against them to obtain compensation for all damages, sums, convictions and costs that may arise from this procedure. . 

 

Article 9 – Warranties

The Seller makes no warranty:

  • that the Site will be error-free or uninterrupted;

  • that any file downloaded from the Site is free of viruses, contamination or any destructive element, the Customer being responsible for the protection of its equipment and data;

  • that the information provided is current, accurate, correct or reliable, although all provided in good faith and believed to be accurate as of the date of publication;

 

The Seller is not responsible:

  • the reliability or lack of security of information circulating on the Internet;

  • the content of third-party websites accessible by hypertext links that may be present on its Site.

 

Article 10 – Management of personal data

In France, personal data is protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code and the European Directive of 24 October 1995 and more recently Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data , (commonly referred to as “General Data Protection Regulation – GDPR”).   The Publisher undertakes to protect all of the User's personal data, which data is collected and processed with the strictest confidentiality, in accordance with the provisions of the aforementioned laws and regulations. . The Publisher undertakes to take all necessary measures to guarantee the security and confidentiality of the personal data provided by the Users of the Site.   No personal information of the User of the Site is published without the knowledge of the User, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Article 11 – Hypertext links

The Site contains a number of hypertext links to other sites (partners, publications, information, etc.) set up with the authorization of G&L Shift OÜ. However, G&L Shift OÜ does not have the possibility of verifying all the content of the sites thus visited and therefore declines all responsibility for this fact as to the possible risks of illegal content. The establishment by the User of the Site of any hypertext links to all or part of the Site is strictly prohibited, except with the prior written authorization of the Publisher. G&L Shift OÜ is free to refuse this authorization without having to justify its decision in any way whatsoever. In the event that the Publisher grants its authorization, this is in any case only temporary and may be withdrawn at any time, without obligation of justification at the Publisher's expense. In all cases, any link must be removed at the Publisher's request. Any information accessible via a link to other sites is not under the control of the Publisher who declines all responsibility for their content. 

 

Section 12 – Cookies

Browsing on the Site is likely to cause the installation of cookies on the User's computer. Cookies are text files, often encrypted, stored in your smartphone or browser. They are created when your smartphone, tablet or computer loads an application or a website: the application or the site sends information to your smartphone or your browser, which then creates a text file. These elements make it possible to record standard information on the pages he has consulted.

All information collected indirectly will only be used to monitor standard statistics related to Site traffic. At no time do these cookies allow the Company to personally identify the User. The shelf life of these cookies in the User's computer does not exceed 12 months. Such a refusal could however prevent the proper functioning of the Site. The User is informed that he has the ability to find out about their nature, to accept or refuse them by modifying the parameters of his browser or smartphone. No cookies will be placed without their consent. We use Wix Analytics, which is a statistical audience analysis tool that generates a cookie to measure the number of visits to our site, the number of page views and user activity. Your IP address is also collected to determine the city you are connecting from. 

 

Article 13 – Applicable law

In the event of a dispute, the parties will seek an amicable solution before any legal action. In the event of failure of these attempts, all challenges to the validity, interpretation and/or execution of the T&Cs must be brought, even in the event of multiple defendants or warranty claims, before the French courts. The present conditions of use of the Site are governed by French law, subject to a specific attribution of competence resulting from a particular text of law or regulation.
